One representative, an authenticated signature, and effect at quarter end
A seller may appoint only one authorised representative for packaging. The appointment requires an authenticated power of attorney in German or English stating the scope, the representative’s express consent to assume the obligations, and the contractual right to conclude binding contracts. An appointment, a change or a termination can only take effect at the end of a calendar quarter, and a mandate that lapses mid-quarter must be continued without a gap.

What is misunderstood about the appointment
It is confused with a tax representative
This is a waste-law appointment. It is not a fiscal or VAT representative and creates no Austrian VAT position for the seller.
An electronic signature is assumed to be enough
The signature on the power of attorney must be authenticated by a notary or a competent sealing authority. Only the signature is authenticated, not the whole document.
The effective date is read as the signing date
The appointment takes effect at the end of a calendar quarter, which is why the file should be prepared well before the boundary you are aiming at.

Does this apply to sellers outside the EU?
The duty is written around the absence of an Austrian seat or establishment rather than the seller’s country of origin, so a third-country distance seller is addressed on the same basis. Confirm the position for your entity before relying on it.
Do I need an apostille?
No apostille requirement was identified in the sources reviewed, but authentication practice outside the EEA should be confirmed for your jurisdiction before the document is executed.
Can I keep two representatives?
No. A seller may appoint only one authorised representative for packaging at a time.
